Moroccan el-Motassadeq to face deportation even if acquitted
Mounir el Motassadeq, a Moroccan suspected of helping 9/11 hijackers, who has been released this week, is to be deported even if acquitted on appeal, said a German official.
Udo Nagel, a top security official, stressing he that accepted the ruling, reiterated that the 2004 decision to deport el Motassadeq will be executed even if he is ultimately found not guilty. "The law is the same for all, even terror suspects. But I emphasise the deportation order is untouched by the latest decision," Nagel said, adding that "he is an Islamist and dangerous for our democracy." Germany's supreme court released el Motassadeq on Tuesday, after he had been sentenced to seven years for belonging to a terrorist cell that included the 9/11 attackers. He is waiting for the outcome of his appeal against the seven-year sentence he received last August for belonging to a terrorist organisation. The judge who issued the ruling said America's reluctance to provide concrete evidence against him made his conviction of complicity in the attacks more difficult. The Moroccan student, 31, has been freed on condition that he remains in Germany, submits his passport and regularly reports to police. The decision faced fierce criticism from politicians and police. "The freeing of alleged terror helper Mounir el Motassadeq is a depressing sign that legal efforts to prosecute those responsible for the Sept. 11 attacks are threatened with failure," Konrad Freiberg, head of the German police union, said in a statement. Wolfgang Bosbach, deputy leader of Chancellor Angela Merkel's Christian Democrats (CDU) in parliament, also pointed out that "this decision is difficult to understand ... I regret it but I have to respect it." On the other hand, Dietlind Weinland, a spokesperson for the Federal Constitutional Court in Karlsruhe, responded that "the court did not decide on his guilt or innocence. He is being released because of a legal process." El Motassadeq was first arrested late 2001 on suspicion that he helped the hijackers who carried out 9/11 attacks on the World Trade Center and the Pentagon. In 2003, he was convicted and given a maximum sentence, 15 years. He thus became the world's first suspect tried in connection with these attacks. |
