Hi there,
I just took it upon myself to start a new thread to answer your post about the US Constitution. This is actually one of my favorite subjects - one which, sadly, I don't find many people well versed enough in to discuss. But you seem to have the knowledge - and that's great!

I agree completely that the United States is based on one of the most enduring and intelligent documents that was ever written. The fact that it has been changed so little since it was written is a testament to that fact.

My point about the Patriot Act was simply - it is unconstitutional legislation. An illegal adaption to the Constitution, "cleverly" hidden in a bill and rushed through congress in the aftermath of a great tragedy.
But the fact that it was even adopted with a sunset clause is beyond me.
I don't particularly feel like waiting until someone actually get to the Supreme Court for this rediculous law to be stopped. It has a sunset clause, if it is not re-newed by the end of the year - it is gone.
So the best thing to do is write your Senators and Congressmen and urge others to do the same. If it is not renewed, then we stop it now. It will be much harder to get rid of if it is adopted again.

What are your thoughts? Or anyone else's for that matter!

New York Girl Oh New York Girl ...!!! the American constitution is a piece of paper who was signed by a bunch of illuminati and free massons , theire agenda was to create a laboratory for theire social theories , it is just a piece of paper ...I persoonnaly do not respect any human made up law , cause I think I could do better than those jerks who wrote it , the only law I do fully abide to is the Devine law which is true and valid independently from time , space , societies , etc.....I prefer anarchy to human made laws and rules ...human make laws to protect theire own interests or to serve theire own agenda , to enslave other humans and to exploite them ...better no law at all , complete anarchy to human made laws !!! at least in anarchy humans act according to theire instinct which is quite pure ...can you please give me your american constitution I want to use it as a toilet paper , cause I am running out of toilet paper

Hello nygirl, and thank you for your question. You are absolutely right; the Patriot Act has a sunset clause and ought not to be renewed. Unfortunately while some provisions in the bill will expire in 2006, powers governing Internet surveillance are not included in the "sunset clause." So they are perpetual. I can promise you that the DOJ will do the impossible to make the Patriot Act permanent. I truly hope they will fail miserably in their calling.

So far the only victims of the Patriot Act were Immigrants, especially those from Middle Eastern, North African and Islamic countries. It has not touch the lives of Americans yet. I say YET, because the executive branch of the US government is known for power abuse, and one day they will use some clauses against American Citizens. It is only then, that the Act can be challenged. Although America is a land of laws, those laws do not equally apply nor protect non-citizens who do not have full access to the judiciary system in the same way American citizens do.

Trust me, many civil liberties organizations are waiting for the first case that would implicate a US citizen to push it to the Supreme Court. It will happen. I believe in our system of checks and balances. It worked for 216 years, and it will work vis-à-vis this bill. And you are definitely right; people should contact their representatives and senators to stop the renewal of this act.

p.s. Don't you think that it is ironic and ludicrous altogether that when the government tries to rob people's rights, they use names like Patriot, American, Homeland, National Security, instead of the true meaning, i.e. surveillance, watch, supervision, despotism and power abuse.

Hi N-J2,

Yes I do think it's ironic and very, very sad. I also find it ironic that it took a 60 page bill, full of convoluted talk to infringe upon the concise writing of the constitution.
I know that the watch-dog groups are waiting for the infringment of a citizens rights to prosecute. The scary part is, the wording of the bill ensures that we wouldn't know if our rights were violated. (In some instances)
There very well may have already been some government agency in my home, searching for whatever. I wouldn't know, because under the Patriot Act, they do not have to reveal that they have my under surveillance or that they are going to enter my home.
How do I prosecute something I don't know exisits? I could possibly request information under FOIA, but I doubt I would get anything substantial.

It's all very shady and unsettling. I truly hope that it comes to pass we get rid of this thing! I think education is the key,though. The more people realize that this is going on, the less the government will be able to pull off.

USA just sucks..

USA is now the worse dictatorship of the whole planet , worse than USSSR ..they watch you , they listen to all your phone calls , they want to know what kind of books you borrow from the library , they want to know what you shoping , what you eat , when you go to whashroom and how many times a day , let alone that they can enter legally to your home inspect it plant hidden cameras and microphones ..the american citizen has no rights , if you are against the war then you are anti patriot , or even a terrorist , you cannot think freely , you just have to be a sheep , work pay taxes eat Mac Donalds and never ever think or question what the governement is doing .......I prefer to live in Morocco where I feel thousands of times more free ...I wonder when we the third world countries start receiving the first refugees from the west , people who want to escape the dictatorships of the west can feel free in our countries and out of the reach of the hands of Big Brother...
