Hashish is not forbidden-Part 3

Dear Morocco.com and others;
What I write is neither to promote division nor to mislead. I only present the evidence. At times we come across tough topics but the truth we must admit. I always try to give the evidence for anything I relay and of course follow the sunnah. Do not let popular trends and high titles make your religion. Always exam everything in relation to the Qur’an and Sunnah then there will be no chance of falling into misguidance, Insha’Allah. To conclude, summarize and bring the issue to a point, let me begin.
Intoxicants are a serious issue. Punishment, death and the hell fire is apart of the use of intoxicants.
Sunan Abu-Dawud, Book 38:
Book 38, Number 4470:
Narrated Qabisah ibn Dhuwayb:
The Prophet (peace_be_upon_him) said: If anyone drinks wine, flog him; if he repeats it, flog him, and if he repeats it, flog him. If he does it again a third or a fourth time, kill him. A man who had drunk wine was brought (to him) and he gave him lashes. He was again brought to him, and he flogged him. He was again brought to him and he flogged him. He was again brought to him and he flogged him. The punishment of killing (for drinking) was repealed, and a concession was allowed.

This is why must be careful when giving opinions about this issue. Saudi Arabia and Indonesia are killing Muslims for possession of hashish. Afghanistan is producing opium for heroin. Morocco is producing wine. Egypt is producing tobacco. There is only one Islam. Is it fair that a Muslim can get the death penalty in one country and nothing in another? How can something be unlawful in one Islamic country and lawful in another?

The Sunnah teaches us that anything that clouds the mind is an intoxicant and forbidden. Also, forbidden are substances that cause lack of energy and vigor.

Sunan Abu-Dawud, Book 26:
Book 26, Number 3678:
Narrated Umm Salamah, Ummul Mu'minin:
The Apostle of Allah (peace_be_upon_him) forbade every intoxicant and everything which produces languidness.

Book 28, Number 3864:
Narrated Tariq ibn Suwayd or Suwayd ibn Tariq:
Wa'il said: Tariq ibn Suwayd or Suwayd ibn Tariq asked the Prophet (peace_be_upon_him) about wine, but he forbade it. He again asked him, but he forbade him. He said to him: Prophet of Allah, it is a medicine. The Prophet (peace_be_upon_ him) said: No it is a disease.

Translation of Sahih Muslim, Book 23:
Book 023, Number 4892:
Wa'il al-Hadrami reported that Tariq b. Suwaid a-Ju'fi asked Allah's Apostle (may peace be upon him) about liquor. He forbade (its use) and he expressed hatred that it should be prepared. He (Tariq) said: I prepare it as a medicine, whereupon he (the Holy Prophet) said: It is no medicine, but an ailment.

The drinking of intoxicants, the Sunnah describes as a disease but the Sunnah describes as a cure the taking of senna. Senna is a laxative which grows in Mecca and elsewhere.

Al-Tirmidhi Hadith 4473 Narrated byAbdullah ibn Abbas
The Prophet (peace be upon him) used to apply antimony three times in each eye before going to sleep, and reported him as saying, "The best medicines you apply are those sipped at the corners of the mouth, those snuffed up the nose, cupping and purgatives...
Tirmidhi transmitted it, saying this is a hasan gharib tradition.

At-Tirmidhi and Ibn Majah narrated that the Messenger of Allah asked Amaa bint 'Umais, ''How do you deal with constipation?''
She said, “By using Shubrum (euphorb piteous). ''
The Prophet said, ''(it is) hot and too strong locative. ''
She then said, “I also use Senna, '' and the Prophet replied, ''If there is a cure that prevents death, it would be Senna. ''
Further, Ibn Majah narrated that 'Abdullah ibn Umm Haram said that he heard the Messenger of Allah saying: ''Use Senna and Sanoot (cumin), because they cure every disease, except Saam. '' He was asked, ''What is Saam?'' He said, “Death ''

Senna is a stimulant in contrast to wine which is a depressant. All depressants, such as wine, beer, opium, morphine, heroin, surgical anesthetics, and others not of mention cause clouding of the mind, languidness and constipation. This is what it means to be a depressant. The intoxicant depresses brain activity. Take the example of the surgical patient. When the surgeon wants to operate he gives the patient depressants to cloud the mind to the point where the patient can not feel the opening of his body cavity by surgical knives. In most cases the patient wakes up with no memory of the operation at all. In cases in which these patients receive too much depressant, the patient must receive stimulants. The point is not to present this as proof but to convey that stimulants do not cause intoxication, languidness or constipation therefore stimulants are not forbidden. Senna, hashish, khat, coffee, tea, tobacco, amongst others are all stimulants.
Secondarily, some information states that the reason these people are coming down on hashish, tobacco and khat is to increase Muslim use of alcohol. They want the Muslims to drink more alcohol. A long time principle in Islam is doing the lesser of two evils so even if hashish is an intoxicant which it is not it is far better then drinking wine which is the original intoxicant the revelations were condemning amongst the Muslims. There is even some scientific evidence that is proving that agents in the cannabis plant decreases the desire for alcohol. And Allaah (soubhanna wa-taa’la) knows best. Also some scholars are of the opinion that caffeine which is in coffee, tea and khat are intoxicants and forbidden due to their addictive potential. Can you imagine how many Muslims are erring if this is true. Addiction is in relation to neglecting remembrance of Allaah(soubhanaa wa-taa’la) and neglecting fulfillment of the obligations of the deen such as prayer. If the Muslim is observing the pillars of Isla then there is no problem. People vary in their addiction therefore addiction is like the affairs of the heart. No one has control and it is only Allaah(soubhanna wa-taa’la) that determines. And Allaah knows best.
