6:145 Say [O Prophet]: "In all that has been revealed unto me, I do not find anything forbidden to eat, if one wants to eat thereof, unless it be carrion, or blood poured forth, or the flesh of swine-for that, behold, is loathsome-or a sinful offering over which any name other than God's has been invoked. But if one is driven by necessity - neither coveting it nor exceeding his immediate need -then [know that], behold, thy Sustainer is much-forgiving, a dispenser of grace."

Translation of Sahih Muslim: Book 032, Number 6248:
Jabir b. Abdullah reported that Allah's Messenger (may peace be upon him) said: Be on your guard against committing oppression, for oppression is a darkness on the Day of Resurrection, and be on your guard against pettimindedness for pettimindedness destroyed those who were before you, as it incited them to shed blood and make lawful what was unlawful for them.

Dear Muslims;
Most recently, on a popular Islamic website there is an opinion (fatwa) that supports the killing of Muslims who do not believe that Hashish is forbidden. Most scholars know that in issues of debate there is no right or wrong position until there is a consensus(ijma) and choosing of either position is valid and not condemnable-punishable. Furthermore, in the case that in fact hashish is forbidden and a fellow Muslim believes that hashish is not forbidden, the Sunnah calls for education of the defendant to wipe away any ignorance of the fact, in depth examination of views to ensure proper understanding and whether forgetfulness, force or insanity is the case. Also a chance for repentance in most cases for the defendant who has beliefs opposing the articles of faith of Islam before execution.

The evidence for this are the words of the Prophet (peace and blessings of Allah be upon him) to a person who confessed that he had committed zina: “Do you know what zina is?” Narrated by Abu Dawood, 4428. This hadeeth was also reported in al-Saheehayn(Bukhari and Muslim).

The Prophet (peace and blessings of Allah be upon him) said: “Allah has forgiven my ummah for mistakes, forgetfulness and that which they are forced to do.” Narrated by Ibn Maajah, 2033; classed as saheeh by al-Albaani in Saheeh Sunan Ibn Maajah, 1664.

The failure to mention this and other facts shows very gross irresponsibility and intolerance. Killing a Muslim is a very serious matter.

Al-Hafiz Abu Al-Qasim At-Tabarani recorded that Ibn `Abbas said that the Messenger of Allah, sallallahu `alaihi wa sallam, said:
“The most hated person to Allah is the Muslim who seeks the ways of the days of ignorance and he who seeks to shed the blood of a person without justification.” [At-Tabarani 10:374]
Al-Bukhari recorded Abu Al-Yaman narrating a similar hadith with some addition. [Fath al-Bari 12:219]

Volume 9, Book 83, Number 17:
Narrated 'Abdullah:
Allah's Apostle said, "The blood of a Muslim who confesses that none has the right to be worshipped but Allah and that I am His Apostle, cannot be shed except in three cases: In Qisas for murder, a married person who commits illegal sexual intercourse and the one who reverts from Islam (apostate) and leaves the Muslims."

The punishment for killing an innocent Muslim is death and the hell-fire. The case can be that you are think you are doing the right action but actually making your own blood lawful to be shed under retaliation (Qisas). This type of view that the killing of a Muslim is permissible if they have not the same view as your own is the same view the Khwaraji who Prophet(sallallaahu ‘alayhi wasallam) describes as the dogs of hell.
Only Allah(subhaanahu wa ta’aala) can declare something lawful or unlawful. The Prophet(sallallaahu ‘alayhi wasallam) says I can not make the lawful unlawful nor the unlawful lawful. This means that all declarations of the lawful and unlawful are in the revelations of the Qur’an and its explanations in the authentic texts-sunnah-hadith.

Translation of Sahih Muslim
Book 004, Number 1149:
Abu Sa'id reported: We made no transgression but Khaybar was conquered. We, the Companions of the Messenger of Allah (may peace be upon him), fell upon this plant, that is, garlic, because the people were hungry. We ate it to our heart's content and then made our way towards the mosque. The Messenger of Allah (may peace be upon him) sensed its odor and he said: He who takes anything of this offensive plant must not approach us in the mosque. The people said: Its (use) has been forbidden; its (use) has been forbidden. This reached the Apostle of Allah (may peace be upon him) and he said: O people, I cannot forbid (the use of a thing) which Allah has made lawful, but (this garlic) is a plant the odour of which is repugnant to me.
Whenever one exerts an effort to find out whether something is lawful or unlawful in Islam that Muslim must always rely only on the evidences in the Qur’an and Sunnah because these are the two places in which Allah(subhaanahuu wa ta’aalaa) reveals his limits of Islam.
The forbidden substances are unlawful due to their intoxication-clouding of the mind, loss of energy-sleepiness. Plain common sense tells us if a substance does not cause clouding of the mind and sleepiness than that substance must not be unlawful for the Muslim. In modern medicine and pharmacology, substances which cause the unlawful effects are Central Nervous System depressants. CNS-depressants causes a decrease in brain activity that is depressants make your brain to stop working. Due to this stopping of the brain activity, all CNS-depressants will cause intoxication-unclear thinking, loss of energy-tiredness. Perfect examples of a CNS-depressants are wine and anything that contains alcohol. Also, opium is a CNS-depressant. CNS-stimulants are substances that cause the opposite effects of the unlawful ones. CNS-stimulants cause clear mind, increase in energy and muscle tightening. Hashish-marijuana is a CNS-stimulant. All of this information is any medical or pharmacological textbook. One of the methods of determining whether a substance is a CNS-stimulant or CNS-depressant is by measuring the blood pressure. Just about anyone in our modern age can get a blood pressure measurement. A CNS-depressant will always cause a lowering blood pressure. A CNS-stimulant will always cause a rising blood pressure, muscle tightening, increase in awareness-energy and clarity of the mind. Other CNS-stimulants are coffee, tea, mint-peppermint, tobacco, senna and kat-chat. The authentic traditions contain the following evidence:

Al-Tirmidhi HadithHadith 4537
Narrated byAsma', daughter of Umays
The Prophet (peace be upon him) asked her what laxative she used and she replied that she used spurge, whereupon he declared that it was very hot. She then used senna as a purgative, and the Prophet (peace be upon him) said, "If anything contains a remedy for death it is senna."
Tirmidhi and Ibn Majah transmitted it, Tirmidhi saying this is a hasan gharib tradition.

Partial Translation of Sunan Abu-Dawud
Book 41, Number 5022:
Narrated Tikhfat al-Ghifari:
Ya'ish ibn Tikhfat al-Ghifari said: My father was one of the people in the Suffah.
The Apostle of Allah (peace_be_upon_him) said: Come with us to the house of Aisha. So we went and he said: Give us food, Aisha. She brought hashishah and we ate. He then said: Give us food, Aisha. She then brought haysah as small in quantity as a pigeon and we ate. He then said: Give us something to drink, Aisha. So she brought a bowl of milk, and we drank. Again he said: Give us something to drink, Aisha. She then brought a small cup and we drank. He then said: If you wish, you may spend the night (here), or if you wish, you may go to the mosque.
He said: While I was lying on my stomach because of pain in the lung, a man began to shake me with his foot and then said: This is a method of lying which Allah hates. I looked and saw that he was the Apostle of Allah (peace_be_upon_him).

Hashishah is simply another spelling of the term like old English spelling versus a new English or modern spelling. If hashish is forbidden then why is there an authentic hadith mentioning hashish amongst other lawful things such soup(haysah) and milk. The best answer to why some scholars are saying that hashish is an intoxicant is that either they simply lack the knowledge of the evidence or their judgment has a basis on knowledge of opium-hashish.

And Allah(subhaanahuu wa ta’aalaa) knows best..

No. It's not referring to "hasheesh".

The word used is sometimes translated as "jasheesha". In this case it's referring to dried out dates (According to a sheikh I asked).
